What will you do to stop this from happening again:

I think I can stop this from happening again by spending more time assessing whether or not I should shoot someone, especially based on whether or not they are reasonably trying to gain an advantage by putting me under gunpoint or pose a threat.

Yes, considering this is an RDM (E) ban I have ~7 RDM warns I believe, two of which are expired.

Why should you be unbanned:

This situation began after I killed Lawliet while he was disguised for pointing a gun at the Ethics Committee Member, which staff deemed valid. This was especially considering he was abusing his disguise by deliberately pointing a gun at the ECM while disguised for no particular reason. Lawliet exited the bunks, came back, walked around with a gun pointed at me, and went behind me in the dark (which was NLR, adding to my decision to kill him, considering I believed he might've tried revenge RDMing me). From my perspective, he had me at gunpoint the entire time until the very last second where I can barely see him pointing down in the clip. I then decided to kill him based on my understanding of what is allowed by the Code of Ethics and server rules. I made this judgement based on these segments:

According to the Code of Ethics, "If Foundation Personnel are found to be a direct threat to life of other Foundation Personnel, the right to self-defense is allowed". I deemed Lawliet pointing a gun at me as a direct threat of life to myself.
According to the server rules, a valid reason for shooting someone (rule 1.1) is "You or someone else is in a life-threatening situation, e.g. you are shot at or held at gunpoint". From my point of view, I was being held under gunpoint by Lawliet, and had a valid reason to shoot and kill him for this.

After I killed him, Lawliet came back from the bunks and proceeded to NLR (for the second time) and revenge RDM me, then proceeded to call a sit for me killing him. You could argue that I should trust him as another member of my regiment to not kill me, but I believe him coming back to revenge RDM me after directly disproves that I could trust him to not immediately come back and kill me after I shot him previously. It seems he had ill intent when coming out of bunks with a gun pointed at me immediately after for this reason as well, to reply to Red's response.

For the revenge RDM/NLR, Lawliet was kicked from Omega-1, considering he was in clear violation of CoC/CoE and server rules after this situation. There have been similar situations to this in the past with Lawliet.

During the sit, Mirage reviewed the clips and wasn't sure whether or not this situation counted as RDM, so they called Head Moderator Red into the support voice channel. Red reviewed Lawliet's point of view and immediately made a decision without reviewing my clip. I believe this did not allow for a fully fair assessment of the situation at the time, and I believe his decision could have been influenced had he seen my clip.

How can you ensure that you won't break any other rule?:

As I said before, I will make an effort to have better judgement regarding killing people, and less on a reflex. My only warns are for RDM, and I make an effort to not break rules on the server.

Why do you want to rejoin this server?:

I have been playing Civil Networks for ~3 months so far, and the server is incredibly fun. I want to keep playing on the server without breaking the rules.

Hi Checkers.

Based on the clips I was shown and what red said when I asked for a second opinion you were banned, Lawliet was also warned for NLR as he came and killed, the first time you killed him was valid as he pointed a gun at the ethics member, but the second time was RDM as he did point his gun away from you after aiming at you for a few seconds.

Many thanks for creating this. I did see your clip later on when going into a chat with an admin and another Hmod. From seeing your side, and the clip presented to me in the sit. I still hold my original standpoint of this being RDM. Because the user that reported this did not seem to have any ill intent they just came out of bunks. Understandably they did have a weapon out, not on safety, but they have not aimed down sights or looked at you fully. But you are all in the same regiment and stood in a very public area. I would not expect a fellow regiment member even with a gun aimed to shoot their men. Otherwise, you would see a lot more killing across the site, which to me personally is not on.

As was stated in a chat with other staff, O-1 can have their own "goofy" moments, which include a few shooting friendlies. But in this situation, it was in a very public area with people watching and commenting, the user that reported this had some grief and believed this was wrong.

Along with 4 previous RDM warnings within the last month. I was and am confident this is RDM.

The reason that this has been denied is because I was asked about this ban at the time and you had no reason to kill a fellow member of your MTF regiment .
